Federal Judge Mandates Release of Kilmar Abrego Garcia from ICE Custody

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.

"Since his return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation stems from a mistaken removal to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to face alien smuggling charges, he was held in federal custody.

In her order, the court noted that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal challenge involve disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.

Conditions of Release

The court, who was overseeing his petition to deportation in a federal court, ruled that he must now comply with the terms of his release from jail in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.
