Michael Jordan Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle

The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, stated that his drive to win and status as a newcomer emboldened his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Financial Stakes and a Will to Win

Jordan shared operational insights of his 23XI team, revealing he invested $40m of his personal wealth into the Nascar Cup series team launched with business partner Curtis Polk and driver Hamlin.

“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at through a new lens.”

Central Issue: Franchise System and Contract Pressure

The heart of the case involves the expiration of a 2016 deal where Nascar granted each team a franchise. This system mirrors other major leagues with independent franchises, like the Charlotte Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar demanded charter membership renewals.

Jordan testified for an hour and exited the courthouse to a media frenzy, with fans and media clamoring for a view or a photo of the global icon.

Leading the Legal Charge

23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan said is breaking the law to keep two hands on the wheel.

At issue for Jordan and a fellow team representative, who preceded Jordan, are events from September 2024. She recounted a frantic and emotional period where the racing circuit told teams they must sign a charter agreement extension. This agreement spanned over a hundred pages detailing pay for chartered teams and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan explained that his team and its ally concluded their only feasible option was to refuse a signature that extensive document and take the issue to court. All other teams agreed to the terms.

The team owners reached out to Nascar about possible changes or negotiations. Nascar wasn’t talking, Jordan said.

The Ultimate Motivation: Victory

Ultimately, the resistance against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Winning.

“Denny convinced me adding a third car boosted our odds of winning,” he testified, noting that he purchased another franchise late in 2024 for $28m despite the uncertainty. “So I took the plunge.”

Heather Gibbs’ Testimony

Heather Gibbs detailed her push for indefinite franchises, which she said a formal letter to Nascar. She testified the pressure of the signature deadline was problematic.

She said, Joe Gibbs first attempted to call and persuade Nascar against demanding signatures, but CEO Jim France refused the appeal.

“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s leadership. She said France replied, “Whether I have 20 charters, that’s what I have. If there are 30, I have 30.”
